Thank you for choosing Car Sales Reading. As a valued customer, we want to ensure that you fully understand your rights under the Consumer Contracts Regulations. This document outlines your right to cancel your purchase when buying at a distance, as well as the terms and conditions associated with such cancellations.
Your Right to Cancel
You are entitled to cancel this contract within 14 days without providing a specific reason. This “cooling-off period” allows you time to reconsider your purchase and, if necessary, exercise your right to cancel under the following conditions:
- Cancellation Period: The 14-day cancellation period begins the day you, or a third party acting on your behalf, collect or take delivery of the vehicle.
To initiate cancellation, you must inform us of your decision in writing. This notification can be sent via post or email to the contact details provided above. If needed, we can provide you with a template cancellation notice form, but using this template is not mandatory.
To ensure your cancellation is valid, your written notice must be sent before the 14-day cancellation period expires.
Effects of Cancellation
When you cancel your contract, the following terms will apply to the handling of payments, vehicle return, and related responsibilities:
- Reimbursement of Payments:
- We will reimburse you for all payments received for vehicle.
- Any reimbursement will be subject to the conditions outlined below regarding vehicle handling and deductions for damage, wear, or excessive use.
- Deductions for Value Reduction:
- If the vehicle has been subjected to handling beyond what is necessary to determine its condition, characteristics, or functionality (e.g., excessive driving beyond a standard test drive), we reserve the right to reduce the amount reimbursed.
- For example, we will deduct £1 per mile driven beyond 20 miles from the reimbursement. Further deductions will apply for damages, excessive wear, or missing components (e.g., keys, documents, or accessories).
- Refund Timeline:
- Your refund will be processed without undue delay and no later than 14 days after:
- We receive the returned vehicle.
- All associated documents (e.g., V5 logbook, service records) are returned in good condition.
- The refund will be issued using the same payment method as the original transaction unless expressly agreed otherwise. No additional fees will be charged for the reimbursement process.
- If a part-exchange vehicle was provided, we will return it if still available. Otherwise, any negative equity from the part-exchange may need to be settled by you.
- Your refund will be processed without undue delay and no later than 14 days after:
- Conditions for Refund Withholding:
- We will withhold reimbursement until both the vehicle and all required paperwork have been returned to us in satisfactory condition.
Your Responsibility for the Return
As the customer, you bear the responsibility for arranging the return of the vehicle under the following terms:
- Timely Return:
- The vehicle must be returned to our premises without undue delay and no later than 14 days from the date you notify us of your cancellation.
- Costs of Return:
- You are solely responsible for the cost of returning the vehicle to us. Please note that Car Sales Reading will not cover any collection or delivery expenses related to the return of the vehicle.
- All arrangements for transport, insurance, and any associated fees are your responsibility.
- Liability Until Return:
- You remain responsible for the vehicle until it has been safely returned and accepted by us. This includes ensuring that the vehicle is taxed, insured, and free from any fines, penalties, or charges during this period.
- Condition of the Vehicle:
- The vehicle must be returned in its original condition, free from damage, excessive wear, or modifications beyond those discussed at the time of purchase.
- Any diminishment in value resulting from unnecessary handling or use will be deducted from your refund.
Handling Guidelines
To minimize deductions, you should handle the vehicle with care. You are permitted to test-drive the vehicle, but driving beyond what is necessary for evaluation will be deemed “excessive use.” This includes but is not limited to:
- Driving the vehicle for purposes unrelated to its evaluation.
- Failure to return the vehicle with its original mileage, minus an allowance of up to 20 miles.
- Incurring damages or excessive wear that was not present at the time of delivery.
